Clear Poreformance Free Giveaway Rules

The Free Giveaway: From 06/10/2010 through 12/10/2010, Clear Poreformance will promote on its website the opportunity to submit entries to win a grand prize as detailed below. Email advertising may also be used to promote the Free Giveaway beginning 06/10/2010 through 12/10/2010.

Eligibility: In order to submit entries, an individual must be at least 18 years of age and reside in the United States. One entry per household is allowed. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Clear Poreformance or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Free Giveaway or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. "Household members" shall mean people who share the same residence at least three months in one calendar year.

How to enter: Complete and submit the official online entry form available on the ClearPoreformance.com website on or before 12/10/2010. All Free Giveaway entries become the property of Clear Poreformance and may be used by Clear Poreformance for any purpose and in any media in perpetuity. By participating in the Free Giveaway, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Free Giveaway without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

How to win: The Grand Prize winner will be selected in a random drawing conducted from all qualified entries on or about 12/15/2010. In the event that the original Grand Prize winner does not meet Clear Poreformance Free Giveaway Rules or eligibility requirements, or he/she forfeits the Grand Prize, Clear Poreformance will then draw another winner. Process will continue until Grand Prize is awarded.

All entries must be received on or before 12/10/2010. The selection will be held the week of 12/15/2010. Decision of the judges and Clear Poreformance is final. The grand prize winner will be notified by email and must respond via email to info@clearporeformance.com with the winner's mailing address, phone number, and any other information required to deliver the prize. The winning entran'ts mailing address, phone number, and other requested information must be received within 15 days of email notification. Any winner who fails to comply within this 15 day period or who cannot be contacted by email forfeits the prize. Clear Poreformance will then draw another winner and follow the same protocol as above.

By entering, each entrant agrees to be bound by the rules. Clear Poreformance, its promotional agents and Free Giveaway co-sponsors are not responsible for lost, delayed, blocked, returned, or misdirected emails, errors in shipments, busy phone signals, or incomplete entries.

Clear Poreformance is not responsible for failed, partial or garbled computer transmission, service outages or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Free Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, other causes beyond Clear Poreformance's control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Free Giveaway, Clear Poreformance reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Free giveaway.

No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any electronic entry to be received on accord on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulted from participation in or downloading any materials from this Free Giveaway. In the event of a dispute over an electronic entry, prize will be awarded to that name on the entry form, not the owner of the e-mail account. Internet entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an internet access provider, on-line service provider, or other organization that is responsible by assigning e-mail addresses or the domain associated with the submitted e-mail address.

Grand Prize: One Grand Prize winner will receive a 12 (twelve) month supply of Clear Poreformance Antibacterial Shampoo and Conditioner, which consists of 12 (twelve) bottles of Clear Poreformance Antibacterial Shampoo and 12 (twelve) bottles of Clear Poreformance Antibacterial Conditioner. The odds of winning the grand prize depend on the number of entries received and are approximately 1:100,000. There are no other prizes.

The Free Giveaway winner will be notified by email and will be asked to email their current physical mailing address to Clear Poreformance at info@clearporeformance.com at that time. The prize will be mailed to the Free Giveaway winner in one shipment consisting of 12 (twelve) bottles each of CP shampoo and conditioner.

Approximate total value of the grand prize is $455.00. The Grand Prize is non-transferable. There may be no cash or other substitutions of prizes by winner. However, Clear Poreformance reserves the right to substitute similar prizes of equal or greater value in the event the above prize is unavailable for any reason. Individual is solely responsible for all applicable federal, state and local taxes with respect to entire prize.

Winner of Grand Prize winner must sign an Affidavit of Eligibility, Release and Indemnification Form ("the Form") that : a) releases, indemnifies and holds harmless Clear Poreformance, its parent, affiliated, subsidiary and successor companies, and its respective officers, directors, employees, agents, and representatives, advertising agencies and promotional sponsors (collectively the "Release") from and against any and all harm, expense, liability or injury that may be sustained relating to or arising from participation in the Free Giveaway or acceptance or use of the prize; and b) authorizes the Release to use the winne's names, likenesses, photographs, voices and biographical data for any purpose, in any media, unless prohibited by law.

Prize will not be released until Clear Poreformance receives all required documents. Failure of Grand Prize winner to return any forms within the required timeframe, or, in the alternative, to contact Clear Poreformance regarding "the Form" and "the Release" via email at info@clearporeformance.com within that same required timeframe, will result in automatic forfeiture of any prizes, and all such prizes shall be awarded to an alternate winner.

Unforeseen Events: Clear Poreformance reserves the right to change this Free Giveaway at its sole discretion at any time that Clear Poreformance becomes aware of any circumstances or occurrence which would materially affect the Free Giveaway security or fairness. Clear Poreformance reserves the right to announce any Free Giveaway rules changes over the air, in print or posters, or on the ClearPoreformance.com website. Clear Poreformance is not responsible for the inability of the winner to accept the prize for any reason.
